                  CLAUSOLA BROKER

                  La Provincia di Fermo dichiara di aver affidato la gestione delle presenti polizze alla Società di brokeraggio Willis Italia S.p.A., ai sensi del D. Lgs. 209/2005 e ss.mm.ii. e segnatamente, al dott. William Fogli ([email protected]).

                  Di conseguenza tutti i rapporti inerenti i contratti di assicurazione relativi alla presente procedura saranno svolti per conto della Contraente dal predetto Broker. Ogni pagamento dei premi verrà effettuato dal Contraente/Assicurato al Broker e sarà considerato a tutti gli effetti come effettuato all/e Compagnia/e, a norma dell’art. 1901 Cod. Civ.

                  Agli effetti tutti delle presenti polizze, ogni comunicazione fatta dal Broker nel nome e per conto del Contraente/Assicurato alla/e Compagnia/e si intenderà come fatta dal Contraente/Assicurato. Parimenti ogni comunicazione fatta dal Contraente/Assicurato al Broker si intenderà come fatta alla/e Compagnia/e. In ragione di detta gestione, al Broker dovranno essere corrisposte, ad esclusivo carico della/e delegataria/e e della/e eventuale/i compagnie coassicuratrici, le provvigioni indicate in ciascun capitolato speciale.

                  L’opera del broker, unico intermediario nei rapporti con le Compagnie di assicurazione, verrà remunerata dalle Imprese, con le quali verranno stipulati i contratti di cui alla presente gara, nella misura indicata nei rispettivi CSP. La remunerazione verrà percepita dal Broker sotto forma di ritenuta sui premi di assicurazione all’atto del loro pagamento. Tale remunerazione è parte dell’aliquota riconosciuta dall’Operatore Economico alla propria rete di vendita diretta e non potrà quindi, in ogni caso, rappresentare un costo aggiuntivo per la Provincia di Fermo.

                  Le spese relative alla pubblicazione del bando e dell’avviso sui risultati della procedura di affidamento, ai sensi dell’art. 5, comma 2, del d.m. 2 dicembre 2016 (GU 25.1.2017 n. 20), sono a carico dell’aggiudicatario/i e dovranno essere rimborsate alla Provincia entro il termine di sessanta giorni dall’aggiudicazione. Le spese relative alla pubblicazione saranno suddivise tra gli aggiudicatari dei diversi lotti in proporzione al relativo valore. La Provincia comunicherà all’/gli aggiudicatario/i l’importo definitivo e le relative modalità di pagamento
